A MOBBERLEY man has been banned from driving after failing to provide a sample of his breath when requested to do so by Cheshire police.

The incident happened on December 5 last year, when Michael Byrne, 66, of Edenfield Road, was stopped by officers in Middlewich, who suspected him of driving under the influence.

Byrne appeared at Stockport Magistrates Court on December 29, where he pleaded guilty to the charge of failing to produce a sample, which is contrary to section 7(6) of Road Traffic Act 1988.

Magistrates disqualified Byrne from driving for a period of 18 months and also ordered him to pay a fine of £583.

Byrne must also pay prosecution costs of £85 and a surcharge to fund victim services of £58.

The defendants guilty plea had been taken into account when Magistrates imposed their sentence.
